These Terms and Conditions govern the commercial relationship between Smart Products I&D SRL and the Client concerning the entire online sales operation by Smart Products I&D SRL to the Client of products presented on Smartproducts.ro.
Smart Products I&D SRL, as the author/owner/administrator of the website smartproducts.ro, reserves the exclusive right to change and update the content of this website, as well as the privacy policy and the general terms and conditions, at any time without prior notice. Therefore, we kindly ask you to visit this section periodically to check the current terms and conditions. The applicable Terms and Conditions for Clients accessing the Smartproducts.ro online store page will be those displayed at the time the purchase order for Products is placed. Smart Products I&D SRL is committed to honoring all statements made to users and customers. It also commits to respecting the terms and conditions.
The purpose of Smart Products I&D SRL is to provide Clients with correct and up-to-date information regarding the products they intend to offer for sale within the online store.
An order represents an electronic document serving as a communication form between the Seller and the Buyer, whereby the Seller agrees to deliver the products, and the Buyer agrees to receive these products and pay for them. The contract represents an order confirmed by the seller.
Smart Products I&D SRL is the author of the smartproducts.ro website and holds all the legal rights recognized to authors, according to Romanian and international legislation. Unless otherwise stated, all materials, including images, illustrations, designs, icons, photographs, audio/video clips, etc., are the property of or licensed to smartproducts.ro for use. The content of the Site, in whole and/or in part, is prohibited from being reproduced, duplicated, copied, resold, visited, or exploited for commercial purposes without prior written consent from Smart Products I&D SRL.
Any online order, whether by email or phone, represents the Client’s agreement to respect the terms and conditions of the website as specified on the site at that moment. By accepting the Terms and Conditions, the Client confirms they have been informed via smartproducts.ro about all the essential elements, namely: the total price of the purchased Products (including taxes), additional transportation, delivery costs, postal fees (if applicable), or any other costs associated with the Products, the validity period of the offers and/or prices for the purchased Products.
“Client” refers to any individual or legal entity that has ordered a product in accordance with the procedure displayed on www.smartproducts.ro and whose order has been accepted by Smart Products I&D SRL. Smartproducts.ro is an online store operated by Smart Products I&D SRL.
The products sold through the smartproducts.ro website may include (but are not limited to) the following types of products within the limits of the legal provisions: electronic products, photo, video, phones, gadgets, batteries, accessories, etc.
Smart Products I&D SRL assures clients that it will take all necessary precautions so that the use of smartproducts.ro is conducted under:
- security through an authorized SSL certificate, which protects the user during the connection with the website www.smartproducts.ro, although it does not guarantee under any circumstances the quality of smartproducts.ro, both functionally and/or technically, or the presence of any potential viruses.
- confidentiality, however, with the obligation of the Client to maintain the confidentiality of their identity data, with the responsibility for any consequences generated by disclosing one or more of these to third parties, which belongs exclusively to the Client, regardless of whether the disclosure is due to an intentional act or an act caused by negligence or carelessness.
Smartproducts.ro Products
Prices may be updated without prior notice, at the exclusive discretion of Smart-Products.
The purchase price printed on the invoice will be the same as the one communicated at the time of placing the order on the Smartproducts.ro website, with all prices including 19% VAT.
Products sold through Smartproducts.ro are new, in the original packaging of the manufacturer, and at the time of delivery, they come with the fiscal invoice and warranty certificate, according to current legislation.
In case a product is no longer available in the current offer of the manufacturer, Smartproducts.ro reserves the right not to honor a certain order.
If the ordered product is found not to conform to the specifications in our offer, you may request a return within 15 calendar days for replacement or reimbursement of the value.
In the case of typographical or calculation errors, as well as errors on the website, Smart Products I&D SRL is not obligated to accept the offer or fulfill the order.
Order Procedure for Products
Orders can be placed directly through the Smartproducts.ro website, through the contact form, or by phone at 037 461 52 26, from Monday to Friday between 09:30 - 18:30.
The Client will give their consent to accept these Terms and Conditions, while also specifying whether they agree to the processing of personal data. If the Client does not agree with the Terms and Conditions, they will not be able to place an order to purchase certain products from the Smartproducts.ro online store.
Smart Products I&D SRL reserves the right to refuse the confirmation of a new order placed by the Client if the same Client already has at least one delivery from Smart Products I&D SRL that has been refused.
All offers and products presented on the Smartproducts.ro website are considered available only within the limits of stock at the time the order is placed, subject to the fact that Smart Products I&D SRL has the right to cancel any order in the event that the product ordered by the Client is no longer in stock at the time the order is confirmed. Smart Products I&D SRL may offer the Client, in certain special cases, the possibility of choosing a product with similar characteristics in exchange for the initially ordered product, without any additional costs to the Client, except for any price differences.
Smart Products I&D SRL has the right to organize promotional campaigns such as Black Friday, Easter, Christmas, and others, in which case the orders placed by Clients will be honored and delivered within the available stock. In case multiple orders for the same product are simultaneously placed by different Clients, the orders will be delivered in the order they were received.
For any order placed by the Client using a shopping voucher, the Client is obliged to follow certain conditions. The method and conditions for using a voucher will be announced on the website at the time the voucher-based offer is launched on the Smartproducts.ro website.
Payment Methods
In exchange for the sale of the Product, the Client is obligated to pay Smart Products I&D SRL the price of the product, as stated on the Smartproducts.ro website. All delivery costs must be paid by the Client, namely the purchase price of the product (including VAT) and delivery costs.
Payment can be made by cash on delivery when the product is delivered by the courier, or the client can pay in advance on the Smartproducts.ro website, using the PO (Netopia Payments) system, using one of the payment methods accepted by the system. For card payments, the transaction will appear on the cardholder's bank statement as an Online Payment. Invoices with orders are only possible in exceptional cases, with prior approval from Smart Products I&D SRL. In the event of a reversal, the client will bear all arising costs. For advance payments, delivery will take place after the money is received in the Smart Products I&D SRL account.
Orders must be placed in full; otherwise, the order will not be honored.
We reserve the right to request advance payment in certain cases!
Online Card Payment
You can make an online payment using your personal or company card, under complete security conditions. The accepted cards for payment are those issued under the VISA (Classic and Electron) and MASTERCARD logos (including Maestro, if they have the CVV2/CVC2 code).
No additional fees are charged for these transactions.
Card data processing is done exclusively on Netopia Payments servers.
The security of your information is guaranteed by the fact that Netopia Payments does not store your confidential card data, but encrypts it and sends it over a secure connection to the processing bank. In this way, your information is secure.

Product Delivery
Products are delivered anywhere in Romania, through rapid courier companies Sameday, Urgent Cargus, Fan Courier, and DPD on weekdays (Monday to Friday) between 9:30 AM – 6:30 PM to the delivery address provided by the Client.
The transport cost for delivery to any of the SameDay lockers is calculated by the courier company, but it cannot exceed 15 lei.
The delivery time is between 24 hours and up to 72 working hours. In special cases and during busy periods, such as Christmas, Black Friday, etc., the delivery time is extended to up to 10 working days.
Smartproducts.ro reserves the right to confirm orders before processing them by contacting clients by phone, email, or SMS.
If the Client cannot be found at the delivery address provided, they will be contacted by the Courier. If the Client cannot be found at the delivery address three times or if the Client refuses to receive the order in front of the courier, Smart-Products reserves the right to consider the order canceled, without generating any compensation or obligations on its part, except for the obligation to return the amounts paid in advance within 14 working days (calculated from the moment the courier establishes the impossibility of delivering the order, either due to refusal or inability to contact the Client). If the order is canceled due to the Client's fault, all costs associated with returning the advanced payments will be borne by the Client, and the amount refunded will be reduced by these costs.
Receipt of the products represents the Client's acceptance that the products have arrived in good condition at the destination.
The transport cost is 15 Lei, a fixed fee. For orders exceeding 500 Lei, delivery is free. Smart Products I&D SRL does not guarantee the exact delivery time selected by the client, nor the completeness of the order. If, unexpectedly, a product is no longer deliverable or requires an extremely long delivery time, the amounts paid in advance will be refunded. Both parties must contact each other to clarify details.
Ownership rights and risks over the Product will transfer from Smart-Products to the Client at the time of actual delivery and signing of the receipt, provided that the Client has paid for the Product either in advance or to the courier, who will issue a receipt for this payment.
If the Client does not pay the full price of the Product(s) at the time of delivery, the package will be returned by the courier to Smart-Products, and the Client's order will be considered canceled.
Compensations
The Client is entitled to compensation only when complaints have been verified by the competent authorities or explicitly acknowledged in writing by Smart Products I&D SRL.
Retained ownership rights
The delivered goods remain the property of Smart Products I&D SRL until all payments have been made or other claims of Smart Products I&D SRL to the client are satisfied.
Warranties
Products purchased by the Client through Smartproducts.ro will be accompanied by the invoice, product warranty certificate, and manufacturer's instructions. The Client is entitled to benefit from the warranty only if they present the original invoice and warranty certificate.
The Client must report any defects of the delivered goods immediately upon delivery. If the complaint is justified and Smart Products I&D SRL is responsible for the defect, the order will either be replaced or a discount will be offered, at the discretion of Smart Products I&D SRL. If a replacement or discount is not possible or the replacement delivery is delayed, the client may request a price reduction or cancel the order. In the case of the Client's withdrawal from the contract, they must return all goods, and the return costs will be borne by Smart Products I&D SRL.
Smart Products I&D SRL is only responsible for damages related to the products delivered. Other claims by the Client—regardless of the legal basis—are excluded.
In the event of the absence of an important guaranteed characteristic or in case of intentional or gross negligence by Smart Products I&D SRL, the limitation of liability stipulated above is not valid.
Responsibility for the damages caused by defects is excluded.
If resold products (clearly highlighted on the website) are sold on the Smartproducts.ro website, they will have a 1-year warranty.
Terms and conditions for electric scooter repairs:
Products under warranty:
In case the product is under warranty, all repair costs, including transportation (round-trip), will be fully covered by our company.
Products that are not under warranty:
If the product is not under warranty or the defect is not covered by the warranty, the customer will be responsible for the costs associated with transportation, diagnosis, and repair. These costs will be determined based on the evaluation carried out by our service department and will be communicated before any work begins. Additionally, if the customer does not wish to proceed with the repair after diagnosis, a diagnostic fee will be charged, as identifying the defect involves technical resources and labor.
Right of Withdrawal
The buyer has the right to withdraw from the contract, i.e., to return a product, within 14 calendar days, without providing any reason and without incurring any costs other than the delivery charges. Thus, according to Government Emergency Ordinance 34/2014 regarding consumer rights, the period for returning a product expires 14 days from:
– the day the buyer physically takes possession of the last item – if the buyer orders multiple products in a single order that are delivered separately
– the day the buyer physically takes possession of the last item or piece – in the case of delivery of a product consisting of multiple lots or pieces.
According to the current legislation, the right to withdraw from the purchase applies only to individual customers.
According to Government Emergency Ordinance 34/2014 regarding the legal framework of distance contracts: “The consumer has the right to notify the trader in writing of their decision to withdraw from the purchase, without penalties and without providing any reason, within 14 calendar days from the receipt of the product. The only costs that may be borne by the consumer are the direct costs of returning the products.”
The returned product must be unused. The return shipping costs will be borne by the customer, and the refund for the product will be made within 14 days of return.
If the product is returned in a condition that makes it unsellable as new, SMART PRODUCTS I&D SRL reserves the right to charge a fee for restoring it to its original state (if possible) or to cover the price difference resulting from selling the product as second-hand.
In the case of electric vehicles, if it is found that the distance traveled by the buyer, an individual, exceeds the maximum limit of 3 km, the price for returning the product will be calculated by the price difference, ranging between 10%-90% of the product’s new price.
The buyer, an individual, should know that any product return is expressly and absolutely influenced by its condition, taking into account the following characteristics: tire wear, brakes, support surfaces, scratches, frame damage, or mechanical defects preventing normal operation.
A preliminary condition for Smart to analyze the return request made by the Customer is the following:
– packages sent by the Buyer must be packed in a way that protects the product from factors that may lead to its damage during transportation (Smart Products I&D recommends that the Buyer use safety elements such as: polystyrene, cardboard boxes, bubble wrap, etc. The product must be packed at least as well as when it was received by the Buyer!)
Products purchased by special order or products that were not part of the company's offer at the time of purchase are not accepted for return.
Products purchased by special order with a received advance payment are not accepted for return.
In the case of special order products with an advance payment, the advance is not refundable if the customer cancels the order.
Refunds or, if applicable, product replacements without penalties and without providing a reason, can be done under the following conditions:
– if the products have a seal, it must not be broken – the product must be returned sealed;
– the condition of the purchased devices and products must be the same as at the time of purchase/receipt.
Refunds for returned orders via courier will be made via bank transfer. Products returned by courier should not be sent with COD (Cash on Delivery).
These provisions apply according to Government Emergency Ordinance 34/2014, in the case of purchasing products from this site using distance communication techniques. The customer can opt for the return/replacement of a product only once. In all cases of return/replacement of products due to withdrawal from the purchase, the return/replacement costs are borne by the customer. Repeated withdrawal from the purchase may be considered abuse.

If the customer requests withdrawal from the contract within the legal withdrawal period, they must return any gifts that accompanied the product. If the order has been paid for, the seller will refund the amount within 14 (fourteen) days from the date the seller is informed by the customer of their decision to withdraw from the contract. The amount will be refunded as follows:
for orders paid by online card –> via refund to the account from which the payment was made;
for orders paid by Op/Cash on Delivery/Transfer/Bank card –> via bank transfer;
The seller may delay the refund until the goods are received.
In case a product ordered by the buyer cannot be delivered by the seller, the latter will inform the customer/buyer about this and will return the value of the product to the buyer's account, within a maximum of 7 (seven) days from the date on which the seller became aware of this fact or from the date the buyer explicitly expressed their intention to terminate the contract.
Products for which the right of withdrawal is not provided
The following are excluded from the right of withdrawal under the contract:
the supply of products whose price depends on fluctuations in the financial market that the Seller cannot control and which may occur during the withdrawal period;
the supply of products made according to the specifications provided by the Buyer or clearly personalized;
the supply of products that are likely to deteriorate or expire rapidly;
the supply of products that, after delivery, according to their nature, are inseparably mixed with other elements.
Given that Smart Products I&D SRL offers free delivery for orders over 500 RON, if the Customer returns the Product, they are obliged to cover both the direct delivery costs for the return of the goods and the initial transport costs from Smart Products I&D SRL to the Customer (for which free delivery was provided).
Another exception applies to heavy, bulky products exceeding 15 kg, including electric scooters and electric scooters, with the customer being required to pay the return cost of 50 RON including VAT for electric scooters and 100 RON including VAT for electric scooters.
In any other situation (except for those mentioned in the previous paragraph) when the Customer returns orders valued at less than 500 RON or returns orders involving mobile phones, the Customer bears the direct costs related to the return of the products. The address to which the Customer will send the Products is as follows: Recon Business Park - Strada Macului Nr. 3, Hala C3/1, Chitila (Rudeni). Smart Products I&D SRL is not obligated to reimburse additional costs if the Customer explicitly chose a different type of delivery than the standard delivery offered by Smart Products I&D SRL.
Products in the electronics category (e.g., phones, tablets, etc.) that the Customer has chosen to password-protect before being returned must be accompanied by the password or the password must be completely removed by the Customer before return.
After receiving the return (entry), Smart Products I&D SRL is obliged to refund the purchase price. Smart Products I&D SRL will refund all amounts received as payment from the Customer, excluding, where applicable, delivery costs for the round-trip, without undue delay, no later than 14 days from the date on which the Customer informs Smart Products I&D SRL of their withdrawal decision, provided that Smart Products I&D SRL assumes responsibility for recovering the goods itself. Exceptionally, since Smart Products I&D SRL retrieves the products delivered to the Customer through the courier company Fan Courier, Smart Products I&D SRL has the right to delay the refund until the products subject to the sale through the online store are received or until receiving proof from the Customer that the products were sent back to Smart Products I&D SRL.
Smart Products I&D SRL is obliged to issue a credit invoice and will refund the Customer all amounts received as payment, less the round-trip transport costs.
Until the goods are picked up by Smart Products I&D SRL, the responsibility/risk is on the customer. The customer's right to a refund of the purchase price is valid only if the returned goods are in the same condition as when the order was received by the customer. The returned products must not be damaged, scratched, bent, cracked, chipped, or have any other signs of wear.
The refund will be made by bank transfer to an account specified by the customer. Smart Products I&D SRL will mention in the credit invoice issued to the customer, in the case of a transfer to an account with a different account holder's name.
If the returned goods from the customer are not in the same condition as when the order was received, accompanied by the invoice, original packaging, and related accessories, Smart Products I&D SRL has the right to choose to refund only part of the purchase price or to refuse the return of the product. In case the product is not properly packed in the original packaging, the customer will be solely responsible for any damage during transport.
Smart Products I&D SRL is obligated to issue a credit note and will refund the Customer all amounts received from them, excluding the delivery costs for the return shipment, without unjustified delay and, in any case, no later than 14 days from the date it is informed of the Customer's decision to withdraw from the Contract. Smart Products I&D SRL is not obliged to reimburse additional costs if the Customer explicitly chose a delivery method other than the standard delivery offered by Smart Products I&D SRL.
For orders paid by card, the amount will be refunded to the same card used for the transaction, within a maximum of 30 days from the acceptance of the return.
ELECTRIC SCOOTERS INFORMATION
Any electric scooter sold under the RYDE brand or on the smartproducts.ro website is not set with a maximum speed limited to 25 km/h. This can only be modified upon your request at the time of purchase. Regardless of the maximum speed the electric scooter can reach, or if it is not limited, when riding at speeds over 25 km/h, you do so at your own risk, with full awareness, and assume any potential consequences.
Personal Data Processing
The Client is recognized the following rights: access and intervention on personal data, justified opposition to processing, protection from individual decisions, and the right to address the judiciary, according to Articles 13-18 of Law no. 677/2001.
The Client has the right to oppose, at any time, free of charge, and without justification, the processing of their personal data provided to Smart-Products during the order process, for marketing purposes.
Any attempt to access personal data of another client/user, to modify the content of smartproducts.ro, or to affect the performance of the server hosting smartproducts.ro is considered an attempt to defraud smartproducts.ro, and Smart-Products has the right to notify the relevant authorities for initiating criminal investigations against the person/people responsible for committing the illicit act mentioned above.
Resolving issues. Applicable law
The applicable law is Romanian law.

In the event that Smart Products I&D SRL and the Customer are unable to resolve the dispute amicably, the case will be forwarded to the competent courts for resolution.
The Customer, whenever they wish to file a complaint, must address it to Smart Products I&D SRL within a maximum of 5 days from the date the reason for the complaint occurred. Smart Products I&D SRL is obligated to provide a response to the Customer at the address provided by the latter within a maximum of 20 days from receiving the complaint.
